These Terms of Service (“Terms”) govern your access to and use of nysacris.com, the Tarot & Treasures online store, and the products, digital content, readings, sessions, experiences and other services offered by NysaCris (collectively, the “Services”).

By accessing our website, placing an order, booking a Service or otherwise using the Services, you agree to these Terms and to any additional policies or conditions applicable to the relevant product or Service.

Nothing in these Terms excludes, restricts or replaces any mandatory rights that you may have under applicable consumer law.

1. Eligibility and Use of the Services

You must be legally capable of entering into a binding contract under the laws applicable to you in order to purchase our products or Services.

Where a product or Service is stated to be available only to customers of a particular age, you must satisfy that requirement.

You agree to provide accurate, current and complete information when placing an order, making a booking or communicating with us.

You are responsible for ensuring that the email address and other contact information supplied with your order are correct.

2. Products and Services

NysaCris may offer products and Services including, depending on availability:

• personalized tarot readings;

• general tarot readings;

• written or email-delivered readings;

• recorded readings;

• private or 1:1 tarot sessions;

• tarot courses and educational materials;

• digital downloads;

• oracle or manifestation-related digital experiences;

• event tarot experiences;

• private, wedding, corporate, hotel, brand and luxury event Services;

• physical products, where offered;

• other spiritual, creative, educational or digital products and Services introduced from time to time.

The availability, format, price, delivery method and description of each product or Service will generally be displayed on the relevant product, booking or offer page.

We may modify, discontinue or introduce products or Services at any time, subject to our obligations regarding orders or contracts already accepted.

3. Orders and Contract Formation

By submitting an order, you offer to purchase the selected product or Service subject to these Terms and any additional conditions disclosed before purchase.

An automated order confirmation does not necessarily mean that an order has been accepted in circumstances where we are legally entitled to refuse or cancel it.

We reserve the right, where legally permitted, to refuse or cancel an order for legitimate reasons, including suspected fraud, payment problems, incorrect pricing, technical errors, inability to provide the requested Service, prohibited requests or circumstances outside our reasonable control.

If we cancel a paid order that we have not provided, we will refund the amount due in accordance with applicable law.

4. Prices and Payment

Prices are displayed in the currency shown on the Store at the time of purchase.

Any applicable taxes, charges or other amounts will be handled or displayed as required by applicable law and according to the configuration of the Store and checkout.

You agree to provide valid payment information and authorize the applicable payment provider to process the amount shown at checkout.

Payment processing may be performed by Shopify and/or other payment service providers available through the Store.

Your use of a payment method may also be subject to the relevant payment provider's terms and privacy practices.

5. Personalized Tarot Readings

For personalized tarot readings, you may be asked to provide information such as:

• your full name;

• date of birth;

• your question or topic;

• relevant background or context;

• a photograph, where requested or voluntarily provided;

• other information reasonably necessary to prepare the reading.

Please provide only information that you are comfortable sharing and that is relevant to your reading.

If you provide personal information concerning another person, you are responsible for ensuring that you are entitled to provide that information.

We may decline questions or requests that we reasonably consider inappropriate, unlawful, harmful or outside the intended scope of our Services.

6. Delivery of Tarot Readings

The delivery method and estimated timeframe for a tarot reading will be stated on the relevant product page, order information or booking confirmation.

Depending on the Service purchased, a reading may be delivered by email, written interpretation, photographs of the cards, recording, live online session or another method described before purchase.

Any stated delivery timeframe is an estimate unless expressly stated otherwise or unless applicable law requires a specific deadline.

Customers are responsible for providing a correct email address and checking their inbox, spam and junk folders.

If you believe your reading should have arrived but you have not received it, please contact nysacrisa@gmail.com.

7. Private and 1:1 Sessions

Private sessions may be conducted through Google Meet or another communication platform identified at the time of booking.

You are responsible for:

• joining at the scheduled time;

• maintaining a suitable internet connection;

• having a compatible device;

• ensuring that you can access the platform used for the session;

• providing accurate contact information.

Booking-specific cancellation and rescheduling conditions may be displayed during the booking process.

If NysaCris must cancel a paid session, we may offer a reasonable alternative appointment. If an appropriate alternative cannot be agreed, the amount paid for the unprovided Service will be refunded.

8. Nature of Tarot and Spiritual Services

Tarot readings and related spiritual Services offered by NysaCris are intended for spiritual guidance, reflection, intuition, self-awareness and personal exploration.

Tarot interpretations are inherently subjective and should not be understood as statements of objectively verifiable fact or guarantees concerning future events.

No particular result or outcome is promised or guaranteed.

You remain responsible for your own choices, actions and decisions.

9. Important Disclaimer

Tarot readings, oracle content, manifestation content and other spiritual Services offered by NysaCris are not substitutes for professional:

• medical advice;

• psychological or psychiatric care;

• legal advice;

• financial or investment advice;

• emergency assistance;

• other regulated professional services.

If you require assistance in one of these areas, please consult an appropriately qualified professional.

Never disregard professional advice or delay seeking appropriate assistance because of information received through a tarot reading or other NysaCris Service.

Your free will and personal judgment remain your own.

10. Questions and Requests We May Decline

We may decline or limit a tarot question or Service request where we reasonably believe that fulfilling it would be inappropriate, unlawful, unsafe or outside the intended scope of the Service.

Where appropriate, we may invite you to rephrase or replace a question.

If we decline an order before providing the paid Service and no suitable alternative is agreed, any amount due to you will be refunded as required by applicable law.

11. Digital Products, Courses and Digital Content

NysaCris may offer digital content including tarot courses, guides, recordings, workbooks, oracle materials, manifestation materials, digital experiences and other downloadable or online content.

Unless expressly stated otherwise, purchasing digital content grants you a limited, personal, non-exclusive and non-transferable right to use that content for your own personal purposes.

Purchasing digital content does not transfer ownership of the underlying intellectual property to you.

You may not reproduce, resell, distribute, publish, upload, share, sublicense or commercially exploit our digital products or course materials without our prior written permission, except where applicable law expressly permits such use.

12. Digital Delivery and Withdrawal Rights

Where you request or consent to digital content being supplied during an applicable statutory withdrawal period, we may request any express consent and acknowledgement required by applicable law before delivery or access begins.

Where all applicable legal requirements for the loss of a statutory withdrawal right have been satisfied, the right of withdrawal may be lost once performance or delivery of the relevant digital content begins.

Nothing in these Terms removes a statutory withdrawal right where the conditions required by applicable law for its loss have not been satisfied.

13. Services Beginning During a Withdrawal Period

Where applicable law provides a statutory withdrawal period for a Service and you request that performance begin during that period, we may ask you to expressly request that early performance.

If you validly withdraw after performance has begun but before the Service has been fully performed, you may be required to pay an amount proportionate to the Service already provided where permitted by applicable law.

Where a Service has been fully performed and the applicable legal requirements concerning the loss of the withdrawal right have been satisfied, the statutory right of withdrawal may no longer apply.

14. Events and Professional Engagements

NysaCris may provide tarot experiences for private events, weddings, corporate events, hotels, brands, luxury events and other professional engagements.

NysaCris may be available to travel internationally for event Services.

Event engagements may be subject to separate:

• quotations or proposals;

• booking confirmations;

• deposits;

• payment schedules;

• cancellation conditions;

• travel and accommodation arrangements;

• event-specific agreements.

Where event-specific written terms are agreed between the parties, those terms will apply to the relevant engagement in addition to these Terms.

If there is a direct conflict between these Terms and a separately agreed event contract, the specifically agreed event terms will generally govern that engagement to the extent legally permitted.

15. Physical Products, Where Offered

NysaCris may offer physical products from time to time.

Descriptions, prices, availability, delivery information and any product-specific conditions will be displayed on the relevant product page or during checkout where applicable.

Images are intended to represent products as accurately as reasonably possible, but differences in screens, lighting, manufacturing or other factors may result in minor variations.

Any statutory rights relating to conformity, defective products, withdrawal or returns remain unaffected.

16. Intellectual Property

Unless otherwise stated, the website and original materials made available by NysaCris, including original text, graphics, branding, course materials, written interpretations, recordings, photographs, digital downloads and other original content, are owned by or licensed to NysaCris and are protected by applicable intellectual property laws.

You may use purchased materials only for the purposes permitted by these Terms and any product-specific licence provided with them.

You may not copy, reproduce, republish, distribute, sell, commercially exploit or create unauthorized derivative commercial products from protected NysaCris content without prior written permission, except where permitted by law.

The underlying artwork, imagery or other intellectual property contained in third-party tarot or oracle decks remains the property of its respective rights holders.

17. Reviews, Testimonials and User Content

If you voluntarily submit a review, testimonial, photograph, comment or other content for publication, we may ask for your permission to use or display that material in connection with NysaCris.

Where permission is granted, we will use the content within the scope of that permission and applicable law.

We will not knowingly represent a testimonial as saying something materially different from what the customer communicated.

Testimonials and individual experiences do not guarantee that another customer will experience the same result.

18. Third-Party Platforms and Services

Our Services may interact with third-party platforms or providers, such as Shopify, payment processors, booking systems, email providers, video meeting platforms, analytics providers or other applications used to operate the Store.

Those third parties may operate under their own terms and privacy policies.

NysaCris is not responsible for independent third-party services to the extent permitted by applicable law, although this does not affect any responsibility that we cannot legally exclude.

19. Prohibited Uses

You may not use the website, products or Services:

• for unlawful or fraudulent purposes;

• to infringe intellectual property or other rights;

• to transmit malicious software or harmful code;

• to interfere with the security or operation of the Store;

However, occasional typographical, technical, pricing or availability errors may occur.

Where an error affects an order, we will handle the situation in accordance with applicable law and, where appropriate, contact you regarding available options.

We do not guarantee that the website will always be uninterrupted or error-free.

We may perform maintenance, updates or modifications from time to time.

21. Returns, Refunds, Cancellations and Withdrawal

Returns, refunds, cancellations and statutory withdrawal rights are governed by our Return, Refund and Cancellation Policy, together with any mandatory rights provided by applicable law.

Different rules may apply depending on whether you purchase a Service, digital content, a booking, an event engagement or a physical product.

A commercial designation such as “final sale” does not override mandatory consumer rights.

Your use of the Services is also subject to our Privacy Policy, which explains how personal information may be collected, used, disclosed and otherwise processed.

Where applicable, cookie and privacy choices can be managed through the privacy controls made available through the Store.

23. Limitation of Liability

Nothing in these Terms excludes or limits liability where doing so would be prohibited by applicable law.

To the maximum extent permitted by law, NysaCris is not responsible for losses resulting solely from a customer's reliance on a tarot interpretation, spiritual guidance or manifestation content as a substitute for professional advice or the customer's own decision-making.

We do not guarantee any particular romantic, personal, professional, financial, spiritual or other outcome from a tarot reading or related Service.

Any limitations or exclusions contained in these Terms apply only to the extent permitted by applicable law and do not restrict mandatory consumer rights.

24. Force Majeure and Events Outside Our Reasonable Control

To the extent permitted by applicable law, we will not be responsible for delays or failures caused by circumstances outside our reasonable control.

These may include significant internet or platform outages, natural disasters, governmental restrictions, transportation disruption, serious illness, widespread service interruptions or similar circumstances.

Where such circumstances affect a paid Service or order, we will take reasonable steps appropriate to the situation and comply with any mandatory obligations applicable to the transaction.

25. Changes to These Terms

We may update these Terms from time to time to reflect changes to our Services, Store, business practices, technology or applicable legal requirements.

The current version will be published on our website with an updated revision date.

Changes will apply prospectively unless applicable law permits or requires otherwise.

The terms applicable to an existing purchase will not be retroactively altered in a way that unlawfully reduces mandatory rights.

26. Governing Law and Consumer Rights

These Terms and our Services are operated by a business established in Romania.

To the extent permitted by applicable law, these Terms are governed by Romanian law.

If you are a consumer residing in another country, this choice of law does not deprive you of mandatory consumer protections that apply to you under the law that cannot lawfully be excluded by agreement.

Nothing in these Terms limits your right to seek remedies or use dispute-resolution mechanisms available to you under applicable law.

27. Entire Agreement and Severability

These Terms, together with the policies and any product-specific or booking-specific terms expressly incorporated into your purchase, constitute the applicable agreement between you and NysaCris regarding the relevant Services.

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.
